Maison 123 is pleased to welcome you and provide you with the www.maison123.com shopping site (hereinafter referred to as the Site).
These general conditions of sale exclusively govern the sales of products offered by Maison 123 on the Site. They are routinely made available on this Site to the Customer when an order is placed. Accordingly, merely placing an order implies full and unreserved acceptance by the Customer of these Terms and Conditions of Sale to the exclusion of all other conditions set out in brochures or catalogues issued by the seller and in particular those in effect in Maison 123 stores.
Unless expressly agreed, any contrary condition set down by the Customer, shall be unenforceable against Maison 123 no matter when it may have been brought to its attention. The fact that Maison 123 does not invoke any of these clauses at a particular time cannot be interpreted as a waiver to invoke them later.
Maison 123 strives to do its utmost to provide accurate and up to date information on this Site. It reserves the right to modify the content at any time and without prior notice.
This Site is for strictly personal use only. It is clearly stated that the purchase of Products on the Site is reserved for non-commercial individuals in their capacity as consumers who are over the age of 18 and have full legal capacity.
In the absence of any condition, it shall be deemed to be governed by French laws and customs in force concerning distance selling.

Article 2: Subject
These conditions are intended, firstly, to inform any potential buyer of the terms and conditions under which Maison 123 as seller makes the sale and delivery of Maison 123 items ordered at the site www.maison123.com; and secondly to define the rights and obligations of the Parties concerning the sale of goods by Maison 123 to the Client . These apply without limitation or qualification to all sales of products offered by Maison 123 on the Site.
Article 3: Product characteristics
3.1 Product characteristics
The products offered for sale are described and presented with the greatest possible accuracy. The information provided on the product data sheet includes the essential characteristics of products (colour, description, composition, maintenance, dimensions), their price inclusive of all taxes, under the conditions specified under Article 4 below.
However, MAISON 123 draws the attention of the Customer to the fact that the photographs cannot be a perfect depiction of the product offered for sale, particularly with regard to colors.
Differences can notably result from the color quality of the photographs, the difficulty of showing on the screen the rendering of the materials or, without however being exhaustive, the technical adaptation. These differences cannot be interpreted as conformity faults and result in the cancellation of the sale. If there is an obvious error or insignificant omission between the product's features and its representation and/or its description, MAISON 123 cannot be held liable.
The products and prices are valid as long as they feature on the Site, within the limit of available stocks.
3.2 Product availability
Products are offered for sale subject to available stock. Only products listed on the website on the day that the Client visits it are available for sale. Thus, when ordering, the customer is informed of the availability of the selected product. Web Customer Service of Maison 123 will be at the disposal of each Client for all questions relating to the availability of goods for sale on this Site.
3.3 Purchase limit
The site does not allow products to be purchased for resale. In this respect, the Client's attention is particularly drawn to the fact that orders may not exceed fifteen (15) articles per order, nor be of an unusual nature or exceed 2,000 Euros. Customers wishing to make a purchase totalling in excess of that amount, provided it is not for the purpose of resale, should contact the Maison 123 Web Customer Department to inquire about the possibilities and conditions of purchase in effect on this site.
Article 4: Price
Prices are given in Euros and are inclusive of all taxes excluding shipping and delivery to the countries concerned. The lump sum payment for the costs of preparation and delivery is communicated to the Customer in the order summary before the order is confirmed. Prices include the VAT applicable on the date of the order. If there is a change in the VAT rate, this will be reflected in the price of the items.
Maison 123 reserves the right to amend prices and product descriptions at any time in the event of increases in charges, including VAT rates, and in the event of typographical errors or an obvious input error. However, products will be billed on the basis on rates applicable at the time the order is recorded unless there is an obvious error. In fact, despite the vigilance of Maison 123, possible price errors can occur on the Site for whatever the reason (computer bug, manual error, technical error, etc.). If orders are placed at erroneous or obviously derisory (very low) prices, they will be cancelled, even if they have been validated by Maison 123's departments. Maison 123 will then inform each of its Customers concerned as soon as possible, in order that they can, if they want to, place the order again at the corrected and accurate price.
The Order constitutes acceptance of the prices and descriptions of products available for sale. Any dispute on this point must be with a view to a possible refund as detailed below in section 8.

Maison 123 referred with Global-e, a third party service acting as a seller-on-record, which provides to buy and ship 123 products to over 100 destinations worldwide. When the Customer buys from Global-e, he will notice that his payment method is charged by **Global-e// 123**, and the purchase is subject to Global-e’s Terms and Conditions and Privacy Policy, which will be clearly presented in checkout before you place the order.

5.1 Customer number
All Customers must fill in the fields given, to create a Customer profile and to obtain his connection identifiers, which are personal. If these identifiers are lost or forgotten, Maison 123 must be informed as soon as possible by contacting the Web Customers Department.
In order to place an order, the Customer must complete a registration form and fill out the information required for his identification:
- Valid email address and password of his choice (confidential and personal) for identification of the Customer on the Site,
- Nominative data marked by an asterisk, compulsory and required for processing the invoices and delivery of orders.
It is important that the Customer fills out the form as accurately as possible in order to avoid any error or impact on the sending of ordered articles. The data registered on this Site are exclusively for Maison 123 or its partners in the case of express acceptance by the Customer under the conditions stated below.
However, any Customer may have the possibility to place an order without previously creating an account, by clicking on “Guest Checkout”. Then, hereunder conditions to validate the order and proceed with its payment will apply.
5.2 Placing an order
Any Customer wishing to place an Order should select the Product of their choice by clicking on “Add to your bag” and then cliking on “Go to checkout”.
After this step, a summary page corresponding to the purchase order appears, allowing the customer to make any changes by clicking “Continue my shopping”.
By validating the order, the Client expressly agree the Terms and Conditions he can read anytime on the website.
5.3 Validation of the order
The Customer guarantees Maison 123 that he has the necessary authorizations to use the payment method that he has chosen for his order, during registration of the order. The Customer, through the validation of his shopping cart, the summary purchase order and acceptance of the general terms and conditions of sale, agrees to move on to the order validation stage through payment. The price owed by the Customer is the amount stated on the summary purchase order, which the Customer has taken note of before validating his order. This validation equals the express acceptance of all of the transactions carried out on the Site.
Any order placed on the Site will be exclusively paid on line via one of the following bankcards: CB, Visa, Mastercard, Amex and all other methods authorized by Global-E.
The order is only processed after entering the bankcard number, its expiry date and the security code (three figures featured on the back of the bankcard) for the payment. This payment is finally validated by the bankcard EIG. The card is debited when the order is dispatched.
5.4 Receipt of order
The final order confirmation is given after confirmation of payment.
An email confirmation of the order and payment will be sent to the Customer confirming their registration along with a summary of all the information already provided and the Terms.

Article 7: TRANSFER OF OWNERSHIP - TRANSFER OF RISKS
Ownership of the articles purchased on the Site can only be transferred to the Customer after full payment of all of the sums due. The non-performance by the Customer of his payment obligations confers on Maison 123 or Global-E the right to demand the immediate return of the articles delivered, at the Customer's expense and risk.

Article 11: Warranty
The products offered comply with the European Union rules in force. Therefore, each customer benefits from a legal guarantee on the items sold applying for a 2-year period starting from the day of delivery of the concerned articles.
In the event of a default occurring within 6 months from delivery, it is probable that the concerned product was already defective when purchased. Beyond this 6 months period, the customer shall be responsible for proving that the default was already inherent when the product was delivered.
This legal guarantee of conformity applies irrespective of the existence of a commercial guarantee.
Article 12: Liability
Despite the care taken over the Site, the photographs and text reproduced and illustrating the products presented, can sometimes include errors: the liability of Maison 123 cannot be incurred in the case of an error in one of the photographs or texts. If an article received does not comply with the one viewed on the Site, the Customer can exchange it and/or have it refunded according to Global-E’s terms and conditions.
Furthermore, Maison 123 cannot be held liable for non-performance of the contract concluded in the event of a:
- stock shortage or unavailability of the product,
- disturbance, total or partial strike, particularly the postal services and means of transport and/or communications, floods, fires, any force majeure event and any other unforeseeable event or one that is outside the control of Maison 123.
Maison 123 will not incur any liability for any indirect damages due to this contract, operating losses, loss of profit, loss of opportunity, damages or costs.

Lastly, Maison 123 accepts no liability

For any question concerning an order already placed, the Customer may contact Global-E Web Customer Service through the "Contact Us" heading in order to directly ask his question.
In the case of a dispute, the Customer must note down the order number as well as the exact reason for the dispute.
Following the resolution of the problem and if a refund is necessary, this is made directly to the Customer's bank account.

Article 15: Personal and confidential data
In order to perform the agreement with Customers, Maison 123 processes Customer's data in order to :
- perform the agreement,
- to inform the customers of upcoming news and events by sending newsletters,
- to inform them about commercial offers and competitions.
In compliance with Regulation (UE) 2016/679 of April 27th 2016, on data protection, the Customer has, at any time, the right of access, of rectification and erasure of personal data and also a right to object to data processing.
To be able to exercise these rights, the Customer simply needs to make a request expressly stating so, providing their personal information and a copy of their identity card, to the following email address : privacy@maison123.com.
The Site is also designed to be particularly attentive to the needs of its Customers. This is the reason why Maison 123 uses cookies. Given the possibility of changes on the Site, Maison 123 reserves the right to make changes to these General Terms and Conditions of Sale at any time. The new Terms and Conditions of Sale will, where appropriate, be communicated to the Client by online changes and will apply only to sales made after the change (those accepted by the Customer at the time the order is placed).
