PERSONAL DATA CONFIDENTIALITY CHARTER

This charter (the "Charter") sets out the personal data and cookies policy of Maison 123 and Etam SCE SAS, subsidiaries of the Etam group (hereafter jointly "we", "our", "Etam"). This Charter informs you of how and when Maison 123 collects your personal data, the reasons for which this data is collected, the use to which it is put and your respective rights. It applies to all information supplied by you or collected by Maison 123 during your interaction(s) with us.

Maison 123, in its capacity as data controller, places great importance on respecting and protecting your privacy. Given that this is such an important subject, we advise that you read the Charter carefully and in full, so you can become aware of and understand how we process your personal data. This Charter sets out the rules relating to the personal data of all our clients and prospective clients, however that data is collected.

When we mention our Platform, we mean one of the channels and/or digital and/or physical services that you can use to interact with us, via the website https://www.maison123.com/fr/ (the "Site"), Maison 123's physical stores, post or telephone.

Maison 123 Loyalty Account refers to the loyalty programme offered by Maison 123, the general terms of use of which are available at the following link: https://www.maison123.com/programme-fidelite-cgu.html

When you use our Platform, Maison 123 may process personal data about you that you have provided to us or that we have collected during your interaction(s) with us.

When you use our Platform, you are subject to the current version of the Charter at that time, and indicate that you accept it. Given that we may modify our Charter at any time as set out in Article 6, we recommend that you check it each time before using our Platform.

1. GENERAL INFORMATION

The data controllers for your personal data are:

We have established guidelines and undertake, jointly, to process and protect your personal data.

Via our Platform, you may be invited to send Maison 123 personal data, for example as part of creating your Maison 123 account and/or joining the loyalty programme, ordering products or subscribing to a newsletter.

Maison 123 may also collect certain information relating to your navigation around the Site. The conditions for this are given in more detail in the "Cookies" section below.

In accordance with the relevant regulations, Cabinet POGGI AVOCAT IT, Anne-Sophie Poggi, avocate à la Cour, 33 Avenue de l'Opéra, 75002 Paris, has been named Data Protection Officer (DPO).

2. DATA CONCERNED

The data that we collect and use varies depending on the products, services or functionalities you wish to access. The personal data that we collect, or that you may choose to provide us with, can be broadly grouped as follows:

  • identifying information, such as your first name, last name, telephone number, home address, email address, photographs you may send to us or images of you when you visit our shops equipped with a CCTV system;
  • payment data, such as your payment card data and data relating to your purchases, orders or returns; 
  • data relating to your online or in-store purchases, such as the product, product size and quantity; 
  • data on your tastes and preferences, such as your preferences within our collections, your colour preferences and your habits; 
  • navigation data on or from your electronic device, such as the date and time of connection and/or browsing, the type and language of your browser, your IP address, your login identification and the tracking of pages viewed. For more information about the navigation data we collect, see Article 5 regarding Cookies and Trackers;
  • location data used to estimate a geographic position, no more precise than city level.

When you apply for a job vacancy within the Etam group featured on our Platform, you may be asked to supply information such as your first name, last name, gender, address, email address, education and training, qualifications and professional experience.

3. YOUR RIGHTS

In accordance with current regulations, you have a range of rights regarding your personal data. You can exercise these rights directly and at any time by contacting us at privacy@maison123.com or Maison 123, Service Clients, 57/59 rue Henri Barbusse, 92110 Clichy, setting out your request and which right you wish to exercise. Once we have received your request, we undertake to process it and respond to it diligently within a maximum of 30 days. If we are unsure as to your identity, we may ask for a copy of your ID or some other proof of identity. Your rights are as follows:

  • Right to access: The right to ask for a copy of the personal data we hold on you. If your request is unjustified or abusive, we can make a charge for this request. 
  • Right to correction: The right to ask us to correct any erroneous personal data we hold on you. We would like to remind you that if you have a client account with us, you can access the relevant section to change or update your personal data. You should check that this data is true and accurate. Moreover, you undertake to inform us of any change or modification to this data. We also remind you that as a general rule you should only communicate your own personal data and not that of third parties. Any loss or damage caused following the provision of inaccurate or incomplete data via one of our data collection forms is the sole responsibility of the Platform user.  
  • Right to deletion: The right to ask us to delete your data, where one of the following conditions applies:
    • your personal data is no longer required for the purpose it was needed for,
    • you have withdrawn your consent and there is no other legal basis justifying the continued processing of your personal data,
    • you have exercised your right to object in a valid manner,
    • it is not legal to process your data,
    • or your personal data must be deleted to comply with a legal obligation. 

There are, however, situations in which you cannot exercise your right to deletion, even if one of these conditions applies (in particular where this is necessary to comply with a legal obligation, or to contest, exercise or defend a legal claim).

To delete your Maison 123 account, you can do so directly from your Maison 123 account, or by submitting a request to privacy@maison123.com or Maison 123, Service Clients, 57/59 rue Henri Barbusse, 92110 Clichy. However, we would like to inform you that deleting your account will automatically result in the loss of any points you may have accumulated as part of our loyalty programme. 

  • Right to object: The right to object to us processing your personal data for our legitimate interests, based on your individual circumstances. In such cases we will stop processing your data, unless we have legitimate grounds to continue to do so. 

If your data is being used for commercial marketing reasons, you have the right to object without needing to give any reason.

  • The right to restrict processing: The right to ask, while we are considering a rectification, objection or deletion request, for the temporary freezing of the use of all or part of your data. During this period we will no longer be able to use this data but will be required to retain it. 
  • The right to portability: If your data is being processed based on your consent or the fulfilment of a contract, and if the processing is being done automatically, you have the right to ask for your data to be sent to you in a structured, widely used and machine-readable format, so that you can transfer it to another entity, if this is technically possible.
  • The right to set out directives as to what happens to your personal data in the event of your death.

You also have the right to make a complaint to a regulatory authority, in particular in the Member State where you usually live, where you work or where the violation occurred, if you think that a violation of the applicable regulations has been committed in the processing of your personal data. You also have the right to withdraw your consent at any time for any processing based on consent. If you simply want to unsubscribe from our newsletter, you just need to click on the unsubscribe link included in every email.

4. MANAGEMENT OF PERSONAL DATA BY MAISON 123

4.1 Purposes and legal basis for the collection of data

The following table shows you how Maison 123 uses your data (the "purpose") and the grounds on which we do so (the "legal basis"):

If you are a member of our loyalty programme and have previously accepted the relevant terms when signing up, or if you provide your email address in an "Abandoned Basket" pop-in made available on the Site, together with the placing and reading of cookies present on the Site, we may offer to help you retrieve your unfinished basket by email within 3 hours and then again within 48 hours of your basket being abandoned.

FULFILLING AND FOLLOWING UP YOUR PRODUCT ORDERS AND PURCHASES MADE IN-STORE Assistance with your purchases and orders in-store
When you make a purchase in one of our stores, our sales assistants may help you with your purchases or orders. They will offer to identify you if you have a Maison 123 account, or to create one if you do not. In both cases, in order to properly fulfil your purchase contract, our sales assistants will need to process all of your information, notably to process your payments and draw up the corresponding invoices. You can pay immediately by payment card, by tap to pay from your device, by SMS or QR code, in which case you receive a link redirecting you to the webpage of our online payment service (by payment card, PayPal). For orders, you will receive a confirmation by email. Except when placing an order (for example for a product unavailable in store), you are not required to identify yourself and can ask the sales assistant to complete your purchase without creating an account.

When you make purchases in store with the assistance of a sales assistant and are identified, we have a legitimate interest in improving your customer experience by providing you with personalised advice.

ENABLING AND MANAGING YOUR REGISTRATION FOR THE MAISON 123 LOYALTY PROGRAMME Creating and managing your Maison 123 account and your loyalty programme membership
Membership of the loyalty programme is automatic when you create a Maison 123 account, either online on the Site or in store with the help of a sales assistant. You provide the identification and contact data needed to identify you and to give you access to the various functionalities, services, information and products available to you. Processing your data is therefore required to fulfil the terms and conditions of our loyalty programme.

Saving additional information to personalise your experience
If you wish, you can also save your telephone number (to receive, if you have accepted, Maison 123 offers and news by SMS or a reminder from your store), your date of birth, as well as data relating to your preferences (such as your size or colouring) on your Maison 123 account, so as to personalise your experience with Maison 123.

Adding your loyalty card to Apple Wallet or Google Pay
If you ask for your Maison 123 loyalty card to be installed in your mobile wallet, namely Apple Wallet or Google Pay, you authorise us to provide the relevant service providers with your identification data – first name, last name and loyalty card number – as well as information about your Maison 123 product purchases.

Managing your loyalty benefits and account information
If you have saved your date of birth on your Maison 123 account, we will send you an email informing you of the benefits you may be entitled to. You will also be informed of the opening of private sales. We will notify you by email of updates to your points balance after a purchase, as well as a reminder before they expire.

PRESENTING YOU WITH PERSONALISED OFFERS, COMMUNICATIONS AND ADVERTISING FOR MAISON 123 PRODUCTS Marketing communications by email, SMS, telephone and post
When you sign up on Maison 123, and at any time thereafter in the "my preferences" tab of your account, you can sign up to receive Maison 123 offers and news by email and/or SMS. At any time in "my preferences", you can also consent to receiving Maison 123 offers and news by telephone and/or post. You can unsubscribe from all or part of these communications at any time from your Maison 123 account, in store with a sales assistant, or by contacting customer service. You can also sign up to Maison 123 newsletters on the Site without being enrolled in the Maison 123 loyalty programme, and unsubscribe by clicking the "unsubscribe" link at the bottom of every email. As regards SMS, you can object to receiving further promotional SMS by replying "STOPM123" to 36980.

Notifications via your digital wallet (Apple Wallet / Google Pay)
If you have added your loyalty card to Apple Wallet or Google Pay, you may also receive Maison 123 notifications on your phone. You can unsubscribe from Apple Wallet and Google Pay notifications via your phone's settings.

Publishing photographs on our media and social networks
If you accept the relevant terms and conditions of use (notably for the social networks you use), we may publish photographs that you have shared publicly or with us on our Platform or our various social networks.

Targeted advertising based on advertising cookies
If you have visited the Site and accepted advertising cookies, you consent to Maison 123 targeted advertising being shown to you on third-party sites, social networks and applications. You can object to this type of advertising by changing your preferences in the cookie preference centre available on the maison123.com site and by deleting cookies stored on your browser (see chapter 5 on cookies below).

Targeted advertising on partner platforms
When you have a Maison 123 account and have made at least one purchase while identified (on our site or in store using your loyalty card), Maison 123 may use certain of your data to display targeted advertising on partner platforms (such as social networks, search engines, video-sharing services). This processing is based on our legitimate interest in promoting our products to an audience likely to be interested in our offering. It breaks down into three distinct purposes, described below.
  • Showing you personalised advertisements for Maison 123 products: Maison 123 may share certain of your data (in particular your encrypted email address) with partner platforms. When you also have an account on one of these platforms, registered with the same email address, that platform may match the email addresses and recognise you. This allows advertisements for products or services similar to those you have already bought or viewed to be shown to you on these platforms.
  • Excluding you from certain advertising campaigns: Maison 123 may also share your data in the same way in order to recognise you on partner platforms and exclude you from certain advertising campaigns shown there, for example when you are already a Maison 123 customer or have recently bought a product. This allows us to avoid needlessly targeting you with irrelevant advertisements and to direct certain campaigns towards people who are not yet Maison 123 customers.
  • Offering our advertisements to people with a profile similar to yours: Lastly, Maison 123 may use your data, under the same conditions, to identify and target people with a profile similar to yours, and to show them Maison 123 advertisements.
Right to object: You can object at any time to the processing of your data carried out for these purposes directly from your Maison 123 account, in the "My account > My settings > My communications" section, by unchecking the "Use of my data for targeted advertising purposes" box.
Legitimate interests
ORGANISING A PRIZE DRAW OR COMPETITION If you take part in a prize draw or competition via the Platform or social media, processing of your data is necessary for the fulfilment of the terms and conditions of the prize draw or competition. Fulfilling a contract

We consider ourselves to have a legitimate interest in processing your personal data where it is strictly necessary to the proper management of your requests and complaints and to responding to your questions. The data that we may process may include photographs if you have decided to send any to us as part of your request or complaint. CARRYING OUT CLIENT SATISFACTION SURVEYS AND STUDIES We consider ourselves to have a legitimate interest in carrying out surveys and research intended to analyse the degree of satisfaction of our clients in order to improve the quality of our products and services.  Legitimate interests
MANAGING THE SENDING OF DIGITAL RECEIPTS In store, you can choose between receiving a paper receipt, not receiving a receipt at all, or receiving a digital receipt. If you have a Maison 123 account, your digital receipts are automatically available in your order history. If you do not have an account, we offer to send you a digital receipt by email; your email address will only be used to send you that receipt. We may also offer to let you receive your digital receipt via a QR code; scanning the QR code will display a link on your phone giving you access to your receipt. You can object to the processing of your data for the sending of a digital receipt by choosing not to receive a receipt, or by choosing a paper printout. Paper receipts are only available at manual tills. In any event, a receipt is required in order to benefit from return or exchange options for a product. Legitimate interests

4.2 Data retention period

The length of time for which we retain your data is determined by the reason for which the data was collected. Once the purpose has been achieved, your data is then archived, deleted or anonymised (in particular for statistical purposes).

In the first instance, data is retained for a period that is no longer than is necessary for the purposes for which it was collected:

MANAGING THE SENDING OF DIGITAL RECEIPTS If you are not a member of the loyalty programme, digital receipts relating to you are retained for 3 years. If you are a member of the loyalty programme, digital receipts are attached to your account and are deleted 3 years after your last Contact with us. If you are not a member of the loyalty programme and have asked to receive your digital receipt by email, your email address is retained for 40 days from the date the email is sent.
CARRYING OUT CLIENT SATISFACTION SURVEYS AND STUDIES 3 years after your last Contact with us.
DATA RELATING TO PAYMENT CARDS If you pay by payment card, the card number and expiry date may nonetheless be retained, in intermediate archives, for a period of 13 months following the debit date, or 15 months for deferred debit payments.
Subject to obtaining your consent, your data (except the security code) may be retained for longer to make payment easier for subsequent purchases, without exceeding the period necessary to achieve this purpose. In other words, your data may be retained until you withdraw your consent, until your loyalty account is deleted and/or until your payment card expires.
MANAGING OUR CLIENT AND PROSPECTIVE CLIENT RECORDS 3 years after your last Contact with us or until you withdraw your consent.
CARRYING OUT COMMERCIAL PROSPECTING AND MARKETING ACTIONS BASED ON YOUR MAISON 123 ACCOUNT DATA 3 years after your last Contact with us or until you withdraw your consent.
CARRYING OUT COMMERCIAL PROSPECTING AND MARKETING ACTIONS BASED ON YOUR NAVIGATION DATA ON THE SITE  13 months from the placement of advertising cookies, or until the cookies are withdrawn.
MANAGING QUESTIONS SENT TO CUSTOMER SERVICE The retention period is 3 years after your last contact with us. Recordings of telephone conversations with our Customer Service team are retained for a limited period (a maximum of 6 months) except where an exception applies (for example for investigation, fraud, litigation or legal purposes).
MANAGING YOUR ELECTRONIC IDENTIFICATION DATA
(YOUR CONNECTION LOGS COLLECTED, SUBJECT TO YOUR AGREEMENT AND YOUR DEVICE SETTINGS, VIA THE USE OF COOKIES AND OTHER TRACKERS PLACED ON OUR SITE)
A period not exceeding 13 months from your connection, in accordance with the applicable regulations. For more details on cookies, how they work and your option to disable them, see Section 5 below "Cookies and Trackers". We use a cookie that is exempt from consent, and data collected via this cookie is retained for 26 months.
MANAGING THE PUBLICATION OF YOUR CUSTOMER REVIEWS A maximum period of 3 years from the publication of your review by Maison 123. As regards the publication of customer reviews online, the retention period may be shorter than 3 years if the item to which the customer review is attached is removed online. 
MANAGING REQUESTS TO EXERCISE YOUR RIGHTS 1 year from responses to requests to exercise your rights.
CARRYING OUT E-COMMERCE STATISTICAL ANALYSIS BASED ON YOUR MAISON 123 ACCOUNT DATA  3 years from the last Contact with us. Beyond this, we only retain anonymous data (aggregated statistics).

 

Furthermore, independent of the retention period necessary to achieve the purpose for which the data is being processed, we may be justified in archiving your data for a limited period, securely and with limited access, in order to: 

  • comply with a legal data retention requirement (for example, the retention period for personal data for accounting purposes is 10 years); 
  • protect ourselves against any potential liability claim, for example following the processing of your personal data. Once the retention period required by law has elapsed and any relevant time-barred actions have passed, your personal data will be deleted or anonymised. 

4.3 Data recipients

Your personal data is intended for the Maison 123 departments concerned by your requests. However:

  • When you order a product on the Site, the personal data that you provide as part of the order is sent to Maison 123 and its affiliated companies in charge of logistics and delivery, or its subcontractors in charge of fulfilling the order.
  • When you make a purchase in store, the personal data you provide may be processed by our affiliated stores. An affiliated store is an independent retailer that operates one or more stores under the Maison 123 name under a commission-agent/affiliate contract. As such, it may consult customer data, create a loyalty account, allow the registration of your loyalty points and let you benefit from promotional offers linked to the loyalty account, acting as a subcontractor within the meaning of the applicable regulations.
  • The data we collect may be passed on to the service providers (subcontractors) that Maison 123 uses to carry out its services for the purposes mentioned above, for example for the management, fulfilment, processing and payment of your orders, as well as for marketing operations. These include, in particular:
    • IT service providers, in particular hosting providers, 
    • delivery service providers, 
    • service providers relating to customer service, customer reviews and satisfaction surveys, 
    • service providers carrying out commercial prospecting campaigns by email and/or SMS, 
    • service providers distributing targeted advertisements (e.g. third-party websites, social networks), 
    • payment service providers and fraud detection and prevention bodies, 
    • data analytics and statistics service providers (store data and Platform data), 
    • police authorities as part of judicial requisitions relating to the fight against fraud, or other authorised third parties.
  • You can log in to your Maison 123 account using your social network accounts. When you log in using a third-party account, it is your responsibility to review the terms and conditions and privacy policy of your social network.
  • Receiving offers and news from Maison 123 partners: your email address may be passed on to partners so that they can send you their offers and news, but only if you have given your consent. You can withdraw your consent at any time directly from your account, or by contacting Maison 123 Customer Service, either by email at privacy@maison123.com or by post at Maison 123, Service Clients, 57/59 rue Henri Barbusse, 92110 Clichy. 

In any event, no data is transferred outside of Europe and the Etam Group does not transfer your personal data, unless:

  • Maison 123 needs to share this information with third parties to provide the service you have requested, or 
  • A judicial or other administrative authority orders Maison 123 to provide them with information, or 
  • You have given your prior consent to sharing that information.

In these cases, appropriate guarantees will be put in place and the security of your data ensured when your personal data is transferred outside Europe. Where a transfer of your personal data outside Europe takes place, it will be based on:

  • an adequacy decision of the European Commission concerning certain countries ensuring an adequate level of protection;
  • standard contractual clauses (SCC) approved by the European Commission;
  • binding corporate rules (BCR); or
  • specific contractual clauses (considered to be compliant with the European Commission's model clauses).

4.4 Data Security

Maison 123 places the greatest importance on the protection and security of its systems and has put in place reasonable precautions to preserve the confidentiality, integrity and availability of the personal data it processes, and to prevent this data from being distorted, damaged or destroyed, or accessed by unauthorised third parties. Technical and organisational security measures have been put in place to this effect.

However, Maison 123 cannot control all the risks relating to the functioning of the Internet, and draws the attention of internet users to the existence of the possible risks inherent to its use and operation.

For the purposes of the technical storage of your personal data, your data is centralised with the following service providers:

  • oXya – in Île-de-France and Hauts-de-France,
  • Salesforce Commerce Cloud - in Ireland,
  • Amazon Web Services – in France, Germany and Ireland,
  • OVH – in Hauts-de-France,
  • OCI – in Île-de-France, Paris.

Maison 123 places great importance on the protection and security of its IT systems. Maison 123 has put tools in place to detect any security breaches. These tools may incidentally involve access to your personal data by the security teams. This data will be collected and processed exclusively for the purpose of managing these breaches and in accordance with the relevant regulations concerning the protection of personal data.

5. COOKIES AND TRACKERS

5.1 What is a cookie?

A cookie, or more generally a tracker, is a text file or identifier that may be saved on your device (computer, tablet or smartphone) and/or when you consult an online service via your browser software. A cookie file allows the issuer to identify the device where it has been saved, for as long as the said cookie is valid or saved.

Maison 123 does not oversee the process used by social networks to collect information about your use of the Site. 5.4 Use of tracking pixels in our newsletters and all electronic communications

Maison 123 may use tracking pixels that are strictly necessary for the sending, tracking and proper management of these communications.

5.5 Your cookie choices

You can express your choices as to whether or not Cookies are placed via our consent management platform (CMP), OneTrust, which is displayed on your first visit. You can then withdraw your consent at any time by reconnecting to the CMP. Please note that you will need to make your choices again if you are browsing in private mode or if you have deleted pre-existing Cookies.

Marketing communications

When you agree to receive Maison 123 offers and news by email, you also consent to the analysis of your interactions with these communications, in particular whether they are opened and clicks on the links they contain.

To this end, Maison 123 uses tracking pixels which may, in particular, be used to:

  • measure and optimise the performance of our marketing campaigns by analysing email opens, clicks made and certain information relating to the device used;
  • personalise the content of our communications based on your interactions with our emails and your interests;
  • adapt the frequency or channel of communication used in order to make our communications more relevant;

You can withdraw your consent at any time from your Maison 123 account, in the "My account > My settings > My communications" section. This withdrawal will end the sending of marketing communications by email as well as the analysis of your interactions with them for personalisation and performance measurement purposes.

Communications relating to your orders, your Maison 123 account and your loyalty programme

Fulfilling a contract
Certain communications are necessary for the management of your Maison 123 account, your orders or your loyalty programme membership. These may in particular relate to order tracking, purchase confirmations, use of your account, your points balance, the expiry of your benefits or the benefits attached to your loyalty programme membership.

Maison 123 may use tracking pixels that are strictly necessary for the sending, tracking, security and proper management of these communications, in particular in order to ensure their deliverability and to manage its distribution lists.

Fraud detection and prevention

Legitimate interest
Maison 123 may also use certain information collected by means of tracking pixels in order to detect, prevent and analyse behaviour likely to reveal fraudulent activity or misuse of its services.

5.7 If you share your device with other users

If your device is used by multiple people and where a single device has multiple browsers, Maison 123 cannot guarantee that the services and advertising sent to your device correspond to your use of the device and not to that of another user.

In such cases, sharing the use of your device and your browser cookie settings with other people is your free choice and responsibility.

7. PERSONAL DATA POLICY AS REGARDS MINORS

Our Site is not aimed at children. We therefore do not knowingly collect, and do not wish to collect, personal data from users who are under the age of 16, except with the agreement or authorisation of the holder of parental responsibility.

If you are under 16 and do not have the agreement or authorisation of your legal representative, we ask you not to provide us with personal data, and to only use our Site if you have informed your legal representative and have their agreement and assistance.

We ask the legal representatives of minors under the age of 16 to help enforce our personal data confidentiality Charter by ensuring that they never provide us with personal data without their prior authorisation.

If information was collected about a minor, the minor's legal representative can contact privacy@maison123.com to rectify, change or delete this information. The person concerned, if they were a minor at the time the data was collected, can also contact us so that we erase the data in question from our databases.

If we become aware that personal data relating to minors under the age of 16 has been collected via our Platform without the agreement or authorisation of the holder of parental responsibility, we will take all necessary steps to delete this personal data from our servers.
